The event will examine recent developments in extradition with a focus on the use of diplomatic assurances. The removal of the concept of mutual recognition in surrender between the UK and EU member states under the TCA and recent high profile extradition cases such as Assange [2021] EWHC 3312 (Admin) demonstrate the growing significance of diplomatic assurances in cases where an individual’s human rights would be otherwise be violated. This seminar will consider when assurances are required, what type of assurances can be given and how courts can be assured that they will be complied with.
